Requires districts to include in quarterly reporting to the state the names of: pupils whose withdrawal is due to extraordinary circumstances, including but not limited to economic or medical necessity or family hardship, as determined by district criteria; pupils who have re-enrolled in school since their names were removed from the attendance rolls; any pupil certified to be a chronic or habitual truant; and pupils previously certified as chronic or habitual truants who have resumed regular school attendance.

Requires districts to establish criteria for the local superintendent to use in determining whether a pupil's failure to attend school is the result of extraordinary circumstances, including economic or medical necessity or family hardship.

Provides for listing of pupils who have re-enrolled. Includes non-public schools. Provides for provision of a comparison of drop out rates. Includes economic or family hardship and medical necessity. Requires a report to the Secretary of State.

LASigned into law 06/2003P-12Requires the principal of any public or private school to notify the office of motor vehicles when any student between the ages of 14 and 18 has been subjected to any of the following disciplinary actions: expulsion or suspension from school for ten or more consecutive school days or an assignment to an alternative educational setting for ten or more consecutive school days in accordance with any policy of the school or of the local public school board, limited to expulsions, suspensions, and assignments to alternative educational settings for infractions involving the sale or possession of drugs, alcohol, or any other illegal substance, the possession of a firearm, or an infraction involving assault or battery on a member of the school faculty or staff. Requires local boards to adopt rules and regulations regarding these provisions.

Requires the driver's license (or learner's license or intermediate license) of any student subjected to any of the above disciplinary actions to be revoked for one year. Allows student to obtain a special identification card, hearing or a hardship license. Specifies that a license suspension under these provisions cannot extend beyond the student's 18th birthday. Allows a student's driver's license to be eligible for reinstatement if, after six months from the date of denial or suspension, the principal notifies the department in writing that the student has displayed exemplary student behavior at school, has not violated any school policies or been found guilty of any misconduct pursuant to R.S. 17:416 or any policy of the school or of the local public school board, and no further disciplinary measures have been taken.

Bars issuer of car insurance from increasing rates or premiums because of any suspension of a license under these provisions.

CASigned into law 01/2002P-12Any minor who is required to be reported as a truant may be required to attend makeup
classes conducted on one day of a weekend and is subject to the following: (a) The first time a truancy report is required, the pupil may be personally given a written warning by any peace officer specified in Section 830.1 of the Penal Code. A record of the written warning may be kept at the school for a period of not less than two years, or until the pupil graduates, or transfers, from that school. If the pupil transfers, the
record may be forwarded to any school receiving the pupil's school records. A record of the written warning may be maintained by the law enforcement agency in accordance with that law enforcement agency's policies and procedures. (b) The second time a truancy report is required within the same school year, the pupil may be assigned by the school to an afterschool or weekend study program located within the same county as the pupil's school. If the pupil fails to successfully complete the assigned study program, the pupil shall be subject to subdivision (c).

(c) The third time a truancy report is required within the same school year, the pupil shall be classified a habitual truant and may be referred to, and required to attend, an attendance review board or a truancy mediation program. If the district does not have a truancy mediation program, the pupil may be required to attend a comparable program deemed acceptable by the school district's attendance supervisor. If the pupil does not successfully complete the truancy mediation program or other similar program, the pupil shall be subject to subdivision (d).

(d) The fourth time a truancy is required to be reported within the same school year, the pupil shall be within the jurisdiction of the juvenile court which may adjudge the pupil to be a ward of the court pursuant to Section 601 of the Welfare and Institutions Code. If the pupil is adjudged a ward of the court, the pupil shall be required to do one or more of the following:
(1) Performance at court-approved community services sponsored by either a public or private nonprofit agency for not less than 20 hours but not more than 40 hours over a period not to exceed 90 days, during a time other than the pupil's hours of school attendance or employment. The probation officer shall report to the court the failure of the pupil to comply with this paragraph.
(2) Payment of a fine by the pupil of not more than one hundred dollars ($100) for which a parent or guardian of the pupil may be jointly liable.
(3) Attendance of a court-approved truancy prevention program.
(4) Suspension or revocation of driving privileges. This subdivision shall apply only to a pupil who has attended a school attendance review board program, a program operated by a probation department acting as a school attendance review board, or a truancy mediation program.

Effective for driver licenses issued after January 1, 1998, persons under the age of 18 must also have successfully passed the criterion-referenced reading test required for all eighth grade students in the public schools, or an alternative reading proficiency test approved by the State Department of Education. School districts are required to offer to re-examine any student who fails to pass the examination and must administer the tests at least six times per year. Districts may charge a fee of up to $25 per re-examination for each subsequent re-examination after the first. S.B. 81 also requires the State Board of Education to administer, or contract with school districts to administer, a reading proficiency test approved by the State Department of Education, in the same manner as for public school students, to any any student not enrolled in a public school. Alternative documentation of reading proficiency may be provided for students with learning disabilities, special education student, alternative education students, and certain other students.

The bill requires any person under 18 years of age who wishes to obtain a motor vehicle operator's license or temporary permit to present to the Director of Revenue a high school diploma or a general education development certificate (GED), or documentation that the applicant is attending high school and has earned a minimum of 2.25 units of credit the preceding semester, is enrolled in a special education program for the handicapped, is enrolled in a private or home school program, is enrolled in an approved alternative curriculum for students at risk, or is attempting to obtain a GED. The bill requires superintendents of schools or chief administrative officers of nonpublic schools or parents in the case of home school students to provide documentation of enrollment status and progress toward graduation on approved forms. If a student drops out of school, has 10 or more consecutive unexcused absences, or has 15 unexcused absences in a semester, the school or parent of a home school student is required to notify the Department of Revenue, which will then notify the student that his or her operator's license will be suspended within 30 days if he or she does not provide required documentation. Persons knowingly submitting false information are guilty of a class C misdemeanor. The bill permits local school boards to decline to pursue revocation of an emancipated minor's driver's license if they determine that it is in the minor's best interest to have a license. The bill also requires parental approval before individuals under the age of 18 who are not emancipated minors may receive an operator's license and contains provisions whereby parents of such children may petition the circuit court to revoke their childrens' operator's licenses.

WISigned into law 04/1994P-12(Effective: 05/04/94) This law allows a county, city, village or town to enact an ordinance prohibiting any pupil who is 16 or 17 years of age from being a school dropout and permitting suspension of the dropout's motor vehicle operating privilege until the child reaches the age of 18. The dispositional order suspending the dropout's operating privilege may be dismissed if the child enrolls in a school program or high school equivalency program. If undue hardship would result from suspension the dropout's operating privilege until the child attains 18 years of age, any of the dispositonal alternatives available for ordinances prohibiting habitual truancy may be substituted. The law provides that an applicant for an instruction permit or a driver's license who is under the age of 18 must submit written verification that he or she has graduated from high school, successfully completed a high school equivalency program or is enrolled in a school program or high school equivalency program and is not a habitual truant.
