Community College
Authorizes the Minnesota Office of Higher Education to match individual student data from the student record enrollment database with individual student financial aid data collected and maintained by the office in order to audit or evaluate federal or state supported education programs as permitted by U.S. Code and Code of Federal Regulations. The office may not release data that personally identifies parents or students other than to employees and contractors of the office.

Community College
Provides that institutions are eligible to participate in state student aid programs if the institution is:
•  operated by the state (MnSCU) or the Board of Regents (U of M);
•  privately operated and has academic standards comparable to Minnesota institutions, is licensed or regulated by OHE, participates in federal financial aid programs by July 1, 2010, or has participated in state financial aid programs and requires signed disclosure forms from each enrolled student recognizing it does not participate in federal aid programs; or
•  offers only graduate programs or programs too short for federal financial aid and the institution is registered or licensed by OHE.

A private institution that does not participate in the federal Pell program must participate within three years of an ownership change to continue as an eligible institution, subject to an appeal for a single one-year extension. Any institution that loses eligibility for the federal Pell program is not an eligible institution for state grants.

DESigned into law 06/2009P-12Creates a pilot Academic Achievement Awards program, which would use federal stimulus funds to make financial awards to schools that significantly close the achievement gap and schools that exceed their adequate yearly progress for two or more consecutive years. The awards are focused on schools that have high percentages of economically disadvantaged students.

UTSigned into law 03/2008P-12Defines a "federal education agreement" as a legally binding document or representation that requires a school official to implement a federal program. Requires gubernatorial approval for federal education agreements that may cost education entities (including the state board of education, the state superintendent and the state office of education, a local school board, a school district, a charter school governing board or a charter school) more than $100,000 annually. Requires legislative approval for federal education agreements that may cost education entities more than $500,000 annually. Sets forth additional procedures for federal education agreements that may cost education entities more than $1,000,000 annually.

Authorizes the governor or the legislature to void federal education agreements lacking proper approval.

Directs a school official, before legally binding the state to a federal education agreement that may cost the state a total of $100,000 or more to implement, to estimate the state and local cost of implementing the federal education agreement and submit that cost estimate to the governor and the Legislative Management Committee.

FLSigned into law 05/2006P-12The Commissioner of Education shall submit to the Legislature the proposed state plan for the reauthorization of the No Child Left Behind Act before the proposed plan is submitted to federal agencies. The President of the Senate and the Speaker of the House of Representatives shall appoint members of the appropriate education and appropriations committees to serve as a select committee to review the proposed plan.

VASigned into law 04/2006P-12Directs the Board of Education to develop a plan to eliminate initiatives or conditions that are currently being funded by No Child Left Behind, unless such initiatives or conditions are an integral and necessary component of the Commonwealth's own Standards of Quality, Standards of Accreditation, or Standards of Learning. Upon development of the plan, directs the Office of the Attorney General must provide the Board and the General Assembly with an estimate of the costs for providing legal services in the event the elimination of any initiatives or conditions results in the withholding of Title I funds. Requires the state board to report its plan to the Senate Committee on Education and Health, the House Committee on Education, the Senate Committee on Finance, and the House Committee on Appropriations by October 1, 2006.

No. 107-110, also known as the No Child Left Behind Act of 2001, to determine if there is a duplication of or a conflict in the legislative mandates in each act. The Department shall submit a report of the review to the Speaker of the House of Representatives, the President Pro Tempore of the Senate and the chairs of the House of Representatives Education Committee, the Senate Education Committee, the House of Representatives Appropriation and Budget Education Subcommittee, and the Senate Appropriation and Budget Education Subcommittee for review by the House and Senate staff no later than September 1, 2003. NMto governor 03/2003P-12HJM 13 states that New Mexico and other western states face funding conditions exacerbated by projections that public school enrollment will increase in the western states while declining in the rest of the nation; that despite wide disparities in expenditures per pupil and pupil-per teacher ratios western states tax themselves at a rate comparable to other states and allocate as much of their budgets to public education as do the other states; that the ability of a western state to fund public education is directly related to the amount of federal land within the state; that a federal policy change ended the sale of federal lands and resulted in a corresponding loss of proceeds to western states; that the ability of New Mexico and other western to fund public education is affected by the fact that state and local property is significant; that land transferred to the western states as trust is difficult to administer and make productive because it is often surrounded by federal land; that the federal government should compensate western states for the significant impact of federal land; that an initiative to increase the level of education revenue in the 13 western states including New Mexico, has been established by the Utah Legislature; and that a resolution urging the United States Congress to compensate western states for the impact of federal land ownership for state education has been endorsed by the council of state governments.
