A significant influence NCLB has had on states has been the requirement that all students be tested annually in grades 3-8 in mathematics and language arts. Student achievement on these tests became the primary indicator of whether schools and districts were making yearly progress.

While some states are still mandated under NCLB, many have applied for waivers from the Law’s requirements, including testing. This does not mean, however, that states are no longer assessing student progress! In order to receive an NCLB waiver, states have had to produce rigorous and comprehensive State-developed plans designed to improve educational outcomes for all students, close achievement gaps, increase equity, and improve the quality of instruction – all of which require that states monitor student progress.

Therefore, even as some states move away from the requirements set under NCLB, all will continue to assess student progress on a regular basis.
